These Terms & Conditions (“Terms”) govern your use of the Fix Med Spa website at fixmedspa.com and any page, form, or feature that links to these Terms (collectively, the “Website”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

Website information is not medical advice

The Website provides general educational and promotional information. It is not medical advice and is not a substitute for an in-person evaluation, diagnosis, or treatment by a qualified health care professional. Do not disregard or delay professional medical advice because of information on this Website.

Using the Website, completing a quiz or form, communicating with us electronically, or requesting an appointment does not by itself establish a provider-patient relationship. A provider-patient relationship begins only after Fix Med Spa accepts you as a patient and the appropriate clinical and consent process has occurred.

Treatment suitability, risks, benefits, alternatives, timing, and expected results vary by person and must be discussed with a qualified provider. Before-and-after images, testimonials, reviews, estimates, and descriptions do not guarantee a particular outcome.

The Website is not for emergencies. Call 911 or seek immediate medical care if you believe you are experiencing a medical emergency.

Eligibility and lawful use

You must be able to enter into a binding agreement to use the Website. If you are using it on behalf of another person or organization, you represent that you are authorized to do so. Minors may receive services only in accordance with applicable law and Fix Med Spa policies.

You agree not to:

  • use the Website for an unlawful, fraudulent, abusive, or harmful purpose;
  • interfere with the Website’s security, operation, networks, or other users;
  • introduce malicious code or attempt to gain unauthorized access to systems or data;
  • scrape, crawl, copy, or use automated means to access the Website except as permitted by law or our written authorization;
  • impersonate another person or misrepresent your identity or authority; or
  • use Website content in a way that infringes intellectual-property, privacy, publicity, or other rights.

Appointments, promotions, and purchases

An online appointment or consultation request is not confirmed until you receive confirmation from Fix Med Spa or its scheduling provider. Availability may change. Appointment deposits, cancellation or rescheduling requirements, no-show fees, refunds, package terms, voucher restrictions, promotion eligibility, expiration dates, and other purchase conditions are governed by the terms presented when you book or purchase and by applicable office policies.

Promotions may be limited, modified, or withdrawn as allowed by law. Unless expressly stated otherwise, promotions have no cash value, cannot be combined, and are subject to eligibility and availability. If promotion-specific terms conflict with these general Terms, the promotion-specific terms control for that promotion.

Pricing and service descriptions may change. We try to keep Website information current, but typographical errors, outdated information, or third-party system errors may occur. Fix Med Spa may correct errors and, where permitted, cancel or adjust an affected request or transaction after notifying you.

Electronic communications

When you submit contact information, you authorize us to respond using the methods described at the point of collection. If you separately consent to marketing calls, emails, or text messages, message frequency varies and message and data rates may apply. Consent to marketing is not a condition of purchasing services. You may opt out of marketing texts by replying STOP and may use an unsubscribe link in a marketing email. We may still send service-related communications permitted by law.

Email and standard text messages may not be secure. Do not use them for emergencies or send sensitive medical information unless Fix Med Spa directs you to an approved secure method.

Our collection and use of personal information is described in the Privacy Policy. If applicable, our handling of protected health information is described separately in the HIPAA Notice of Privacy Practices.

The Website may link to or embed services operated by third parties, including appointment scheduling, payment, maps, reviews, social media, analytics, advertising, and security providers. Third-party services are governed by their own terms and privacy policies. Fix Med Spa does not control and is not responsible for third-party content, availability, security, or practices. A link or integration does not necessarily mean that Fix Med Spa endorses every statement, product, or service offered by the third party.

Intellectual property

The Website and its text, photographs, graphics, logos, design, layout, videos, and other content are owned by Fix Med Spa or used with permission and are protected by intellectual-property laws. Subject to these Terms, Fix Med Spa grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for personal, noncommercial purposes.

You may not reproduce, distribute, modify, publicly display, create derivative works from, sell, license, or commercially exploit Website content without prior written permission, except as allowed by law. Names, logos, service marks, and trade dress appearing on the Website may not be used without permission from their respective owners.

Feedback and submissions

You are responsible for information you submit through the Website and must have the right to provide it. Do not submit unlawful material or content that violates another person’s rights. If you send non-confidential ideas or feedback about the Website, you permit us to use that feedback without restriction or compensation. This provision does not apply to medical information, personal information governed by our Privacy Policy, or protected health information governed by our Notice of Privacy Practices.

Disclaimer of warranties

To the fullest extent permitted by law, the Website is provided “as is” and “as available.” Fix Med Spa disclaims warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, secure, or free of harmful components, or that its content will always be complete, accurate, or current.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Fix Med Spa and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, or business opportunity, arising from or related to the Website or these Terms.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from gross negligence, willful misconduct, or rights that applicable law makes non-waivable. These limitations concern use of the Website and do not alter any separate rights or obligations relating to professional health care services.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Fix Med Spa and its owners, officers, employees, and agents harmless from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Website, your violation of these Terms, or content you submit in violation of another person’s rights. This section does not require you to indemnify any party for its own unlawful conduct.

Changes and availability

We may update these Terms by posting a revised version and changing the “Last updated” date. Changes apply prospectively when posted unless a later date is stated or applicable law requires otherwise. We may modify, suspend, or discontinue all or part of the Website at any time, subject to applicable law.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute relating to the Website or these Terms that is not subject to another binding agreement will be brought in a court of competent jurisdiction in Los Angeles County, California, unless applicable law requires a different forum.

If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with policies and additional terms expressly incorporated here, are the entire agreement concerning use of the Website.
